One year ago today...

...a disabled woman died because her husband wouldn't feed her and didn't think anyone else should feed her either.

The case went before a judge and the judge found the husband guilty of felony neglect and sent him to jail appointed a guardian for the disabled woman ordered the police to arrest anyone who as much as tried to moisten the woman's lips with water.

Meanwhile, women's advocacy groups such as NOW demanded to know why a man who was shacking up with another woman and stood to inherit a pile of money when his wife died was permitted to be the disabled woman's guardian demanded an investigation into past allegations of abuse and neglect had nothing to say.

The mainstream media did serious investigative journalism into the disabled woman's original injuries publicized interviews with nurses who'd cared for the disabled woman in the past demonstrated their concern for the rights of the disabled by publicizing the serious concerns that the disability community had about this case did a profile on George Felos that included his claims to be able to psychically communicate with brain-damaged patients repeated whatever the husband's lawyer told them.

The doctor who was ordered to remove the feeding tube told the husband to go to hell did it.

One year ago, a woman who had committed no crime and was tried by no jury was ordered by a judge to be starved to death. And one year ago today, she died.

I Am Confused

I questioned in the comments box over at Fr. Rob's, why did Michael Schiavo want to get married in the Church? He totally shown disdain for any Catholic perspective the whole time he killed his wife, what did it matter to him?

Disgusted

I saw George Felos' press conference at 2.30 this afternoon talking about the importance of "Mrs. Schiavo's peaceful death process" and whine about Father Pavone's straight arrow comments-"he was using the pulpit as an idealogue and was very harsh..." Oh boo hoo! You starve an innocent woman to death and cry that someone disagrees with you. Do people actually believe this crap?

Next week George Felos is going to be before Judge Greer claiming our blue sky is purple and then we'll have a NYT gallop poll stating 70% of Americans agree the sky is in fact purple, and only crazy right wing Christians see the sky is blue.

No More Apologizing

With every major moral dilemma that comes up lately, the media always blasts the "conservative, religious right". Like many of us, I am tired of it. For a very long time, I have felt the need to distance myself from the image of some of the stranger Christian fanatics that I know. Kind of like "Hi, I'm Pansy. Yes, I'm a pro-life Catholic, but I am not weird. Yes I homeschool, but I am not weird. I am open to life and have 5 kids, but I am not weird." I think I felt so strongly because I know some really strange people through either homeschooling groups, the Latin Mass or the Internet who fit the bill of the fanatical, non-charitable, judgemental fundamentalist. I wanted so badly to distance myself from that image because there is such a stigma against being too far right. But you know, I spent much of life around many far left people, and from my experience the far left people I know mostly at some point in time personally contributed to the death of another whereas people I know who are too far right are just kind of anal and annoying.

Fact is I am starting not to care anymore. I think the Terri Schiavo case has drawn a line, and if this case has not, there will be more to come in the near future that will. Truth be told, I am not defining myself as anything, I am too busy to do so. But I believe that starving this poor woman to death is murder. I believe abortion is murder. I will continue to say Mel Gibson did a great thing by making The Passion both artistically and spiritually. I see a real moral drought promoted in many of the traditional school settings that is getting worse and as long as I see that I will homeschool. I think birth control is evil. These things make me I guess someone who doesn't think for themselves, or a fanatical, far right or whatever the buzz terms are so be it. I refuse to apologize anymore and am tired of feeling the need to explain why I feel the way I do.

This world just has done gone mad and like my boy Kanye says, "only Jesus can save us."

Terri's last hope: SCOTUS?

Lakeland, FL, Dec. 30 (UPI) -- A Florida appeals court has ruled the parents of a Tampa, Fla., woman should not get a trial in their effort to keep her alive.

The decision by the 2nd Court of Appeal in Lakeland, Fla., could leave the U.S. Supreme Court as the only recourse for the parents of Terri Schiavo, The Tampa Tribune said Thursday.

In a separate hearing on Thursday, Pinellas County Circuit Court Judge Greer heard arguments from George Felos, who asked the court to end his stay on the removal of Terri's feeding tube early, on Friday. Attorney for the Schindlers, David Gibbs, countered by asking Judge Greer to continue the stay indefinitely.

But in a surprise decision, on Friday Judge Greer issued the indefinite stay requested by Gibbs on behalf of the Schindlers.

The decision barring the removal of Terri's feeding tube indefinitely has prompted Michael Schiavo's attorney, George Felos, to consider ending his efforts to kill Terri:

"I think we are coming very close, if we are not here already, where proceeding in the judicial system is futile," said George Felos, who represents Michael Schiavo in his quest for court permission to stop feeding his brain-damaged wife. "It would appear that pursuing any remedy through the judicial system is simply a waste of time," Felos said. "It is hard to see where there is any benefit in staying the course in this case."

I just made a comment in your Terri Schiavo thread where I listed phone numbers to call in her ongoing defense by ordinary citizens. When I followed up with a call myself to the Dir. of Pub. Info for the Fla. supremes, they are now giving only an answering machine reply of "due to volume of calls" best way to comment is to e-mail or just leave message. I left a message anyway. But... when calling the Gov's office I was told that Gov. Bush is appealing the case to the Supreme Court. That's good. When I asked if they were receiving many calls, she said only 2 today so far!!

With the power of bloggers examining the Rathergate stuff and just today finding another flawed CBS report, can we, with your help again, unleash another "Power of the Blog" for Terri and get those calls going to Gov's office with accompanying horror reactions to Fla supremes. He needs our support for what he's still trying to do even during this trying time of emergencies in the state.

Kangaroo Courts are Killer Courts

CURE's statement on the Schiavo decision:

While those seeking to murder Terri have denied her the opportunity that she deserves for rehabilitation and while they have distorted Terri's condition in their Goebbels-style campaign to dehumanize her, this battle has never been about the medical facts.

Nor should it be! The life of a person living in [a] coma deserves no less protection than the healthiest TAB (temporarily able-bodied person). In fact, it requires and deserves greater protection, and any civilization that has transcended the jungles of social Darwinism would provide it.

Florida: If the hurricanes don't get you...

the judges will.

You've probably heard that the Florida Supreme Court has ruled that the governor is not constitutionally permitted to intervene when a patient without written advanced directives is scheduled to be starved to death.

Governor Bush is going to appeal, and Michael has graciously agreed to wait to commence the starvation while the governor submits his appeal. What a guy!

Father Johansen has posted Terri's parents' statement. He also brings us a link to a new blog by Cheryl Ford, the registered nurse working with Terri's parents who broke the news of the "exit protocol" written to make Terri look comfortable as she starves to death.

Starvation is not a peaceful death.

Even its advocates know it isn't a peaceful death, even as they assure us it is.

Father Johansen has posted the "Exit Protocol" devised for Terri Schiavo back in 2001, when her feeding was scheduled to cease in April. It was discovered during a review of her medical records at the Hospice (and the fact that Terri has lived so long at the Hospice should itself be a clue: she's not terminally ill, she's disabled.)

The protocol is a care plan designed to minimize Terri's suffering she underwent as she starved to death (wait a minute -- weren't we being told she can't feel anything anyway and would be undergoing a quick, easy death?)

The Hospice expected that Terri would probably experience pain, skin breakdown (everything from chapped lips to skin ulcers was addressed in the plan), dry mouth, and an inability to manage the thickening secretions in her nose and mouth. The Hospice planned to administer morphine by nebulizer when her breathing started to grow labored.

And, when she began to experience uncontrollable muscle twitching and spasms (ever had a Charley horse?) the plan was to give her diazepam (Valium). They had even anticipated the possibility that Terri would suffer grand mal seizures.

"An easy way to go." "This is what Terri would have wanted."

Pain, skin breakdown, choking on one's own mucus, gasping for breath, and seizures. "Painless." Uh-huh.

A Novena for Terri: Day 1

Father Johansen notes that August 31 is an important day for Terri: the Florida Supremes will hear arguments as to the constitutionality of "Terri's Law", and Judge Greer will face re-election.

Bad news about Terri. Please see Father Johansen's for the ugly details: another legal setback, poor care (now she's got a bedsore, which really makes me see red), the whiff of corruption and cronyism....

Then there's that other wacky thing with the "puncture wounds." What's up with that? It could be something as simple as someone drawing a blood sample on the wrong patient and leaving the room a mess. At least Governor Bush wants to know what's up with that too.

Mark Windsor is wondering if the new IG for Florida's Agencey for Health Care Administration is aware of the level of care presented to Terri Schiavo. (You know, if she were a dog PETA would be chaining themselves to the doors.)

Mark also suggests finding someone to run against Judge Greer this November. How about one of our own Floridian St Bloggers?

Nat Hentoff on the abuse question

Nat Hentoff, a writer of great integrity, has been writing a great series this week about Terri Schiavo. He takes up the abuse question in this piece: Was Terri Schiavo Beaten in 1990?

Ann Coulter weighs in on the Schiavo case

....The same people who want to kill Terri believe death row cases are never final, no matter how many courts and juries have spoken over how many decades.

Moreover, it's not as if court after court has heard testimony on Terri's wishes and have all unanimously agreed that Terri would have chosen death. One lone Florida circuit court judge, George Greer, credited Michael's testimony, finding "clear and convincing" evidence that Terri said she would not want to be kept alive on feeding tubes. Because Judge Greer was acting as the finder of fact, his finding is essentially unreviewable by any other court.

Judge Greer's finding on Terri's wishes may be immune from legal review, but it's not immune from criticism. He's a finder of fact; he's not God. A few years ago, Judge Greer found that Helene Ball McGee did not have reasonable cause to believe domestic violence was imminent and denied her an order of protection. Two weeks later, Mrs. McGee was stabbed to death by her husband. So judges can make mistakes....

Michael wasn't always Terri's guardian....

...and as Wesley Smith points out, the court-appointed guardian thought it would be better that way:

Because of these conflicts of interest, the Probate Court appointed Richard L. Pearse Jr. of Clearwater, Florida, as Terri's guardian ad litem and instructed him to investigate the matter and report back with a recommendation. Pearse filed his report with the court on December 28, 1998 urging that the court deny the petition to remove Terri's food and water.

And He Calls Himself a Man?

I cannot find a transcript online yet since the show ended a few minutes ago, so I am doing this from memory. When Michael Schiavo was asked about his girlfriend he said something like "I am very fortunate to have two women in my
life who I love." I feel sick.
Update:I had nightmares over this last night. I only watched it briefly out of curiosity. When I hear or know someone who for whatever reason feels they have the right to play God with people's lives, I often wonder what it is about them that makes them feel so much more special than anyone else. I mean, was he like so much more divinely hotter looking, or smarter or sumthin' sumthin'? Well, maybe to himself, I dunno. He looked creepy to me. He looked like one of those men that would be online behind you at Starbucks making slightly off colored jokes in his girlfriend's ear within ear shot as if to say "guess what, we have sex!" and that I would give dirty looks to for invading my hearing zone, and would give me "oh lighten up already looks in return." Dontcha hate it when that happens? Anyway, a bit of digression there.

In that snippit I tried to quote (again, working from memory here), Larry asked him something like "You could have divorced Terri and married your new girlfriend. No one would blame you in this situation. Why haven't you?"
Slime Boy:"Because I made a promise to her to let her die."

Woohoo, I normally like a guy who promises to give me the world, and rings and love, and you know, happy stuff. Oh but this guy promised "death".

And oh how noble! He gets his girlfriend but he is a loyal and loving husband because he will not divorce his poor wife because she needs to die. America is buying this crap?

Death stuff aside, if my husband had a girlfriend, and said to me "I cannot divorce you because I promised to support you..." or some other BS like that, well the benefit is women not imprisoned in Hospice Care homes can use their boots...

I am just so, you know, ugh! I just cannot believe the stuff he said and how people think this is noble. This world has gone stark raving mad.

Sorry how this blog was supreme rant and lacked any kind of form whatsoever. As I am writing this my husband is telling me to stop bidding on ebay and my boys are throwing toys at each other. Another day...

Well I have only recently become familiar with this case however i am split on my thoughts. I Feel for all people involved with this situation. and pray for their grief. I have expressed in the past to my spouse that i would not want to live like teri's condition or any condition where i was unable to continue to feed myself or take care of myself and have never felt the need to discuss this with my parents this legislative ruling shows not only should i do that but perhaps put in some sort of order with the state clerk. Listening to her brother they have not had medical records or acess to doctors reports in the past 10 yrs perhaps there is more then they know at this point. May god allow the one that i entrust with my wishes make the decsion for me and not a body of lawmakers or any other party that thinks they have my best intrest in mind but rather the one that i share my deepest most inner thoguhts to on this subject and may he allow the others to grieve properly for their loss

Am I Missing Something?

Mark Shea highlights some of the current articles who state is was "unconstitutional" for the Governor, or anyone to intervene in allowing Terri to starve to death. OK, no matter what you think about the immoral "Right to Die" stance, in my opinion, it is stupid that anyone should starve to death in American today. It is despicable to force someone to starve to death. Even if it were Terri's last wish (yeah right) like her husband claimed to "die with dignity", the law has a right to jump in and say "well, tough cookies, people are not put to death from starvation on this country."

What kind of society are we coming to where this can be justified?

OK, I have to find something lighthearted and meaningless to blog about. I am disgusted about the attitude I am reading and am even reading Catholics who support this. My gag reflex needs to calm down.

Federal Judge Kills Bid To Bar Schiavo Ruling

At an emergency hearing, Lazzara openly doubted whether he has jurisdiction to intervene in a right-to-die case that has been winding through state courts for five years. He termed the Schindlers' new federal lawsuit a ``quintessential shotgun pleading,'' but added: ``given the importance of what's at stake here, I'm going to proceed.''

Thanks for this link to the Mighty Barrister, who explains why the headline is misleading. Basically, the federal judge wants Terri's parents to polish up their complaint. They have ten days to do this before they can be heard again in federal court. They'll be bumping right up against September 11 -- the date that the Florida judge set for removal of the feeding tube.

Terri's case goes to Federal level

The judge will be hearing Terri's case at 2PM Eastern time. Anyone care to join me in prayer at that time?

Pansy and I have been following this case closely, and it seems like every day there's some new appalling detail. How I hope that this is the beginning of the end of Terri's mistreatment! Do take a look at Terri's parent's Complaint -- some of the details, especially about the husband's kooky lawyer, will curl your hair:

30. Mr. Felos' book, Litigation as Spiritual Practice, contains numerous bizarre anecdotes about his ardent desire to end the administration of food and water to severely disabled or gravely sick patients.

31. On page 63, referring to his landmark Florida state court case, Estate of Browning, Felos writes: "Such a deep, dark, silent blue. I stared as far into her eyes as I could, hoping to sense some glimmer of understanding, some hint of awareness. The deeper I dove, the darker became the blue, until the blue became the black of some bottomless lake. 'Mrs. Browning, do you want to die?...Do you want to die?' - I near shouted as I continued to peer into her pools of strikingly beautiful but incognizant blue. It felt so eerie."

32. On page 73, Attorney Felos writes: "As I continued to stay beside Mrs. Browning at her nursing home bed, I felt my mind relax and my weight sink into the ground. I began to feel light-headed as I became more reposed. Although feeling like I could drift into sleep, I also experienced a sense of heightened awareness. As Mrs. Browning lay motionless before my gaze, I suddenly heard a loud, deep moan and scream and wondered if the nursing home personnel heard it....In the next moment, as this cry of pain and torment continued, I realized it was Mrs. Browning. I felt the mid-section of my
body open and noticed a strange quality to the light in the room. I sensed her soul in agony. As she screamed I heard her say, in confusion, 'Why am I still here... why am I here?' My soul touched hers and in some way I communicated that she was still locked to her body. I promised I would do everything in my power to gain the release her soul cried for. With that the screaming immediately stopped. I felt like I was back in my head again."

33. On page 75, Felos says: "Before our son was conceived, my then wife and I went through a long and arduous process trying to decide if we should have a child. Given that our marriage was never very stable, the familiar arguments against creating progeny seemed at times hard to overcome....One morning, while still generally engaged in that process, I walked into my office, and about half way to my desk was hammer-struck. While almost seeing stars like a comic book character, I heard the soul of my yet-to-be-conceived child emphatically shout: I'm ready to be born... will you stop this fooling around!'...The voice I heard was distinctly male, and I beamed with the idea I had a son - or was going to have a son - or sorta had a son out there - or something like that."

34. On page 216, again discussing Estate of Browning, Mr. Felos writes about the late Estelle M. Browning: "As I always did, I looked into her eyes and shouted to her, hoping for some response or sign. After a minute or two I sat in the chair by the foot of her bed, closed my eyes, and started to meditate. Having 'soulspoken' with Mrs. Browning when we first met, I decided, with a measure of earnest self-inflation, to purposefully initiate such contact. I settled into my breath and noticed all the passing sounds move through my consciousness. As I deepened my relaxation, I reached out with my awareness to see if I could touch her soul-presence. From deep inside I repeated, 'Mrs. Browning, it's okay to leave your body. There is no reason to stay in this body. It is all right to die now.' A few minutes into my meditative encouragement, I was jarred by a high-pitched sarcastic cackle and the words, 'You're telling me to drop my body - and you can't even get out of your head.' Apparently, Mrs. Browning had a spirited sense of humor!"

35. On pages 181-182 of his book, Felos claims that merely by visualizing a plane crash during a flight he was taking back to Florida, he caused the plane to begin to crash and that God spoke to him at that moment to warn him: "Be careful what you think. You are more powerful than you realize'.....I was startled, humbled, and blessed by God's admonishment."

36. Co-conspirator Felos clearly is not simply an advocate for Michael Schiavo in the Florida state courts; he is an investor in Mrs. Schiavo's case who stands to profit financially via her judicially-sanctioned death and the book he told the St. Petersburg Times he wants to write about the case and his "spiritual journey" with Theresa Schiavo.
As his first work, Litigation as Spiritual Practice, indicates, Mr. Felos is an egomaniacal visionary who views Terri's hoped-for death as a fulfillment of his personal messianic mission as the savior of severely disabled and seriously ill people who need to die. He is a protagonist in a drama in which he sees himself as a lead character....

45. Non-party co-conspirator Felos has been paid approximately $550,000.00, virtually the entirely of Terri's estate, for his professional services to defendant Schiavo in the Florida courts, and no funds from the estate have been used for her rehabilitation."

And then there's the affadavits filed by three nurses who had cared for Terri, such as this one by Carla Iyer, RN (emphasis added):

To the best of my recollection, rehabilitation had been ordered for Terri, but I never saw any being done or had any reason at all to believe that there was ever any rehab of Terri done at Palm Gardens while I was there. I became concerned because Michael wanted nothing done for Terri at all, no antibiotics, no tests, no range of motion therapy, no stimulation, no nothing. Michael said again and again that Terri should NOT get any rehab, that there should be no range of motion whatsoever, or anything else. I and a CNA named Roxy would give Terri range of motion anyway. One time I put a wash cloth in Terri's hand to keep her fingers from curling together, and Michael saw it and made me take it out, saying that was therapy....I made numerous entries into the nursing notes in her chart, stating verbatim what she said and her various behaviors, but by my next on-duty shift, the notes would be deleted from her chart. Every time I made a positive entry about any responsiveness of Terri's, someone would remove it after my shift ended. Michael always demanded to see her chart as soon as he arrived, and would take it in her room with him. I documented Terri's rehab potential well, writing whole pages about Terri's responsiveness, but they would always be deleted by the next time I saw her chart. The reason I wrote so much was that everybody else seemed to be afraid to make positive entries for fear of their jobs, but I felt very strongly that a nurses job was to accurately record everything we see and hear that bears on a patients condition and their family. I upheld the Nurses Practice Act, and if it cost me my job, I was willing to accept that."

So this nurse alleges that on top of everything else, there's been tampering with legal documents, sanctioned by the hospital where Terri was staying. This hospital probably receives Medicare funding. I hope the Inspector General gets involved.
